Our Commitment to Family Safety

These Terms of Service ("Terms") govern your use of the Chorely mobile application and services. By creating an account or using Chorely, you agree to these Terms. If you do not agree, please do not use the app.

1. Acceptance of Terms

By accessing or using Chorely, you confirm that:

• You are at least 18 years old, OR
• You are a minor using the app under the supervision and consent of a parent or legal guardian
• You have the authority to enter into this agreement
• You will comply with all applicable laws and these Terms

2. Description of Service

Chorely is a family-oriented household management app that:

• Enables families to organize and track household tasks (chores)
• Gamifies chore completion through a points-based reward system
• Allows photo evidence submission for task verification
• Provides reward redemption options including custom rewards and third-party gift cards
• Facilitates family group management and communication

3. Account Registration and Security

3.1 Account Creation

• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the confidentiality of your login credentials
• You must notify us immediately of any unauthorized use of your account
• One person may not create multiple accounts

3.2 Parental Accounts

• Group organizers (typically parents/guardians) are responsible for:
• Creating and managing family groups
• Inviting and removing members
• Supervising minors' use of the app
• All activity within their family group

3.3 Account Termination

• You may delete your account at any time through the app settings
• We may suspend or terminate accounts that violate these Terms
• Upon termination, your data will be deleted in accordance with our Privacy Policy

4. Acceptable Use Policy

4.1 Permitted Use

You may use Chorely to:

• Organize household tasks within your family
• Track chore completion and award points
• Upload appropriate photo evidence of completed tasks
• Redeem points for rewards

4.2 Prohibited Conduct

You agree NOT to:

• Upload child sexual abuse material (CSAM) or any content exploiting minors - ZERO TOLERANCE, immediate termination and law enforcement reporting
• Upload or share content that is offensive, indecent, sexually explicit, violent, hateful, or discriminatory
• Upload content that infringes on others' intellectual property rights
• Upload content depicting illegal activities or dangerous behavior
• Harass, bully, or threaten other users
• Impersonate others or misrepresent your identity
• Attempt to hack, disrupt, or compromise the app's security
• Use the app for any commercial purpose without authorization
• Share your account with others outside your family group
• Create fake accounts or manipulate the points system
• Upload malware, viruses, or harmful code

4.3 Consequences

Violation of these rules may result in:

• Content removal
• Account suspension or termination
• Legal action if required by law

5. User-Generated Content

5.1 Your Content

• You retain ownership of photos and content you upload
• You grant Chorely a license to store, display, and process your content solely to provide the service
• You represent that you have the right to upload all content you submit
• You are solely responsible for your content

5.2 Content Moderation

• Chorely reserves the right, but is not obligated, to monitor, review, or remove user content
• We may remove content that violates these Terms without prior notice
• We do not endorse or verify user-generated content

5.3 Content Visibility

• Content uploaded to Chorely is visible only to members of your family group
• We do not make user content public or share it outside your group
• Group organizers have full visibility of all group content

6. Points and Rewards

6.1 Points System

• Points are awarded by group organizers for completed tasks
• Points have no real-world monetary value
• Points cannot be transferred between groups or users
• We reserve the right to adjust points balances if fraud or abuse is detected

6.2 Custom Rewards

• Group organizers can create custom rewards (e.g., privileges, treats)
• Chorely is not responsible for fulfilling custom rewards
• Disputes about custom rewards must be resolved within your family

6.3 Third-Party Gift Cards

• Some rewards may be fulfilled by third-party providers
• Chorely acts only as a facilitator for these transactions
• We do not guarantee the availability, quality, or delivery of third-party rewards
• All claims regarding third-party rewards must be directed to the respective provider
• Third-party providers have their own terms and policies

7. Parental Responsibility and Child Safety

7.1 Parental Supervision

Parents and guardians are responsible for:

• Supervising minors' use of Chorely
• Monitoring content uploaded by minors
• Ensuring tasks assigned are age-appropriate and safe
• Teaching children about online safety and appropriate content

7.2 Real-World Safety

• Chorely does not supervise or verify the completion of real-world tasks
• Parents must ensure all assigned tasks are safe and appropriate for their children
• Chorely is not liable for injuries or incidents occurring during task completion

7.3 Age Requirements

• Children under 13 cannot create accounts independently
• Parents must create and manage accounts for minors
• Parents consent to data collection for minors in their family group

8. Intellectual Property

8.1 Chorely's Rights

• The Chorely app, logo, design, and content are owned by Chorely or its licensors
• You may not copy, modify, distribute, or reverse-engineer the app
• All trademarks and service marks are the property of their respective owners

8.2 Feedback

• If you provide feedback or suggestions, we may use them without obligation or compensation to you

9. Disclaimers and Limitation of Liability

9.1 "As Is" Service

CHORELY IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

9.2 No Guarantee

We do not guarantee that:

• The app will be uninterrupted, secure, or error-free
• Defects will be corrected
• The app is free of viruses or harmful components
• Results from using the app will meet your expectations

9.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CHORELY SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, or goodwill
• Service interruptions or data loss
• Any damages arising from your use or inability to use the app
• Real-world incidents or injuries related to tasks coordinated through the app
• Disputes between family members regarding tasks or rewards
• Third-party reward provider failures or disputes

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO CHORELY IN THE 12 MONTHS BEFORE THE CLAIM (OR $100 IF NO PAYMENT WAS MADE).

9.4 Indemnification

You agree to indemnify and hold Chorely harmless from any claims, damages, or expenses arising from:

• Your use of the app
• Your violation of these Terms
• Your violation of any rights of others
• Content you upload

10. Privacy

Your use of Chorely is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your information.

11. Third-Party Services

Chorely may integrate with third-party services (e.g., Firebase, gift card providers). Your use of these services is subject to their respective terms and policies. Chorely is not responsible for third-party services.

12. Modifications to Terms

We may update these Terms from time to time. We will notify you of material changes through:

• In-app notifications
• Email to your registered address
• Updated "Last Updated" date

Continued use of Chorely after changes constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the app and delete your account.

13. Modifications to Service

We reserve the right to:

• Modify or discontinue features at any time
• Change pricing or introduce fees (with advance notice)
• Impose limits on features or storage

14. Governing Law and Disputes

14.1 Governing Law

These Terms are governed by the laws of England and Wales, without regard to conflict of law principles.

14.2 Dispute Resolution

• Informal Resolution: Before filing a claim, you agree to contact us at support@chorely.app to resolve the dispute informally.
• Mediation: If informal resolution fails, we encourage mediation through a mutually agreed mediator.
• Court Jurisdiction: Any legal proceedings shall be brought in the courts of England and Wales.

14.3 Exceptions

Either party may seek injunctive relief in court for intellectual property violations or unauthorized access.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Chorely regarding your use of the app.
